  • Consumer Agreement

  • The Purchaser requests Global Cooling Inc. (GCI) to sell and supply to it the sensors and controllers, and other accessories, in the quantity and at the prices agreed and on the following terms and conditions.

    In ordering the device, the Purchaser acknowledges and agrees that:

    1. GCI acts only in the capacity of agent of the various manufacturers (MFG), and any representations, statements, or warranties contained in the product descriptions and installation guides or in any promotional brochure provided in relation to the these are understood to have been made, or authorized to be made, by each respective MFG.

    2. It has made its own enquiries as to the suitability of using same to monitor ethylene concentrations in fruit ripening and citrus degreening applications, and judged that the components are suitable for connection to the a SCADA or other programmable logic controller operated by it and that it has the necessary software and hardware to display the ethylene concentration, and other values, monitored by the transmitters in the manner required by the Purchaser.

    3. It acknowledges installation of the transmitters must only be undertaken a qualified electrician or that by similarly qualified professional and in accordance with the MFG's directions.

    4. It understands appreciates a failure to follow the MFG's product description and installation guide, or and that failure to ensure proper maintenance, installation and operation of the electronics may result in personal injury, damage to property or financial loss.

    5. It understands and appreciates that a failure to follow the product description and installation guide may result in inaccurate monitoring of ethylene levels and a build up of ethylene, which may result in damage to property, death or serious personal injury.

     

    6. It acknowledges it is solely responsible for the safe and correct programming of the SCADA or other programmable logic controller and releases and indemnifies GCI against any claim, cause of action or demand for personal injury, property damage, financial or any other form of loss or expense arising out of or in connection with programming SCADA or other programmable logic controller,

    7. The ethylene sensor is only recommended to be used in fruit ripening and citrus de-greening operations where to Ripegas or other non-flammable gases are utilized, and preferably where a Catalytic Generator is the ethylene-producing device.  Use of the ethylene transmitter in environments where flammable gases are present poses a risk of explosion, which may result in personal injury, damage to property or financial loss. This ethylene sensor is forbidden to be used with pure ethylene gas discharged from pressurized cylinders.

    8. It releases GCI from any claim, cause of action or demand for personal injury, property damage, financial or any other form of loss or expense arising out of or in connection with the use or operation of the transmitter in an environment where flammable gases are present" in an incorrect manner, in a manner contrary to, or which fails to comply with, the recommendations or instructions of GCI or MFGs, or in an improper manner for which the Transmitter was not designed.

    9. It indemnifies GCI against any claim, cause of action or demand for personal injury, property damage, financial or any other form of loss or expense arising out of or in connection with the use or operation of the transmitters in an environment where flammable gases are present, in an incorrect manner, in a manner contrary to, or which fails to comply with, the recommendations or instructions of GCI or MFGs.

    10.  It acknowledges warranty as to fitness for purpose, durability or otherwise provided in respect of the any transmitter is expressly excluded to the extent permitted by law and to the extent any such warranty is unable to be excluded, it is provided by the MFGs and not GCI and it agrees that GCI is not responsible and releases GCI from any obligation, to the extent permitted by law, to repair or replace the Transmitter or refund moneys expended in purchasing the Transmitter as a result of the Transmitter failing to operate as intended.



  • International

  • Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

    Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. Global Cooling & Postharvest is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.
